Schedule E — SanyaSMS

Operational rules for the SanyaSMS gateway — sender-ID registration, prepaid credits (from TZS 18/SMS, no expiry), carrier-failure crediting, consent, and prohibited messaging. Attaches to the Master Terms.

Schedule E — SanyaSMS. This Schedule attaches to the Master Terms of Service and applies to customers of SanyaSMS — our bulk and transactional SMS gateway (web app and API), collectively "SanyaSMS" in this Schedule. Several rules below are imposed on us by the Tanzania Communications Regulatory Authority (TCRA) and the mobile network operators, and we pass them through to you. On any SanyaSMS matter, this Schedule prevails over the Master (Master §17).

E.1 Service Scope

SanyaSMS lets you send bulk and transactional SMS to recipients in Tanzania (and, where available, other markets) via our web app and REST API. We route your messages to the mobile network operators (MNOs) through licensed aggregation. We are responsible for the gateway; you are responsible for your content, your sender ID, your recipient lists, and your consent to message them.

E.2 Sender-ID Registration (TCRA)

To send with an alphanumeric sender ID (e.g. NETPOA), the sender ID must be registered and approved through TCRA and the MNOs before it can be used. You apply through SanyaSMS and provide supporting documents (company details, sample content, and the brand the sender ID represents).

  • Turnaround: approval typically takes up to 14 business days, and is outside our sole control — it depends on TCRA and the operators.
  • Truthfulness: the sender ID must accurately represent you. You may not register a sender ID that impersonates another organisation, a government body, or a brand you do not own.
  • Liability for the ID: you are responsible for content sent under your approved sender ID. A sender ID may be suspended or withdrawn by TCRA or an MNO for abuse, and we must comply.

E.3 Credits — Purchase & Pricing

SanyaSMS is prepaid and pay-as-you-go. You buy SMS credits up front; each message segment sent consumes credits at the per-SMS rate in force at the time of sending. Our rate is from TZS 18 per SMS to all Tanzanian networks, with no monthly fees. High-volume senders may qualify for an even lower custom rate; certain international or special destinations may cost more. New accounts receive 100 free SMS on signup. One SMS is up to 160 GSM-7 characters; longer messages are split into multiple billed segments.

No expiry: purchased credits do not expire — they remain on your account until used or until the account is closed (see §E.10). We surface your balance in the dashboard.

E.4 Carrier-Failure Crediting

You are charged for messages we accept and submit to the operator. Where a message fails at the carrier before delivery and the operator returns a permanent failure delivery report (e.g. invalid/unreachable number, network rejection) for which no charge is passed to us, we credit the corresponding amount back to your balance, typically automatically once the delivery report is final.

  • Messages reported delivered, or accepted by the operator and billed to us, are not credited — delivery to a switched-off or full handset that the network accepts for later delivery counts as a chargeable, accepted message.
  • Crediting is based on operator delivery reports. Where an operator does not return granular reports, the operator's status is final.
  • Crediting covers carrier failure only; it does not cover messages you sent in error (wrong list, wrong content).

You must have a lawful basis and the recipient's consent (or another valid basis under the Personal Data Protection Act, 2022) to message each recipient. You must:

  • Honour opt-out / STOP requests promptly and maintain suppression lists.
  • Identify yourself clearly in marketing messages.
  • Keep records demonstrating consent, which you must produce on our or TCRA's request.

You are the data controller for your recipient lists; we process them on your behalf only to deliver your messages (see Data Protection).

E.6 Prohibited & Restricted Content

In addition to the Acceptable Use Policy, you may not use SanyaSMS for: unsolicited spam; fraud, phishing, smishing, or impersonation; lottery/gambling scams; messages promoting illegal goods or services; content that is defamatory, obscene, or incites violence or hatred; or any message prohibited by TCRA, EPOCA, or MNO policy. Certain categories (financial, adult, gambling) may require additional approval or be disallowed entirely by the operators.

E.7 Political-Campaign Messaging

Political-campaign SMS may not be sent without the recipient's prior consent and full compliance with all applicable Tanzanian law, TCRA directives, and any National Electoral Commission rules in force (including any election-period restrictions). Specifically:

  • You must hold demonstrable consent from each recipient to receive political messaging — generic or purchased lists are not a lawful basis.
  • The sender ID and content must clearly identify the responsible party.
  • We may require evidence of consent and of any necessary authorisation before enabling political-campaign traffic, and may refuse or suspend it to comply with a TCRA or regulatory directive.
  • You indemnify Netpoa Limited for any claim, fine, or sanction arising from political messaging you send (Master §10).

E.8 Sending Windows & Throughput

Throughput (messages per second) depends on your account tier and operator capacity. Operators and TCRA may impose time-of-day windows for promotional traffic (e.g. restrictions on late-night marketing); transactional/OTP traffic is generally exempt. We pass through any operator-imposed window or throttle. Sustained sending that triggers spam filters may be throttled to protect deliverability for all customers.

E.9 Billing

SanyaSMS is prepaid: you fund your balance before sending, by mobile money, card, or bank transfer (Master §4). Per-message rates are shown at purchase and may change with operator wholesale pricing; changes apply to credits purchased after the change.

E.10 Refunds

Purchased credits are non-refundable for cash, except for the carrier-failure crediting in §E.4 (returned as credits, not cash). Credits do not expire (§E.3); unused credits are forfeit on account closure. See Refund Policy.

E.11 Suspension & Termination

We may suspend or terminate SanyaSMS immediately for: spam or abuse complaints, a TCRA or MNO directive, suspected fraud, sending prohibited content (§E.6) or non-compliant political traffic (§E.7), or chargeback/non-payment. Where a suspension results from your breach, unused credits may be forfeit. Where we suspend in error, we restore your balance.

E.12 Message Retention

Message content and delivery logs are retained for 90 days for delivery, billing, audit, and dispute purposes, then deleted, unless a longer period is required by law or an active investigation. You can export your sending history from the dashboard during that window.

E.13 Fees

Per-SMS rates, sender-ID registration fees (if any), and dedicated short-code/long-number pricing are quoted at order time and shown in the dashboard. All fees are in TZS, exclusive of VAT unless stated.
